VENDOR GUIDELINES - 2024 FESTIVAL

Application

Please note---BOOTH SPACE AND OR REGISTRATION IS NOT CONSIDERED COMPLETE UNTIL PAYMENT IS RECEIVED IN FULL AND ALL APPLICABLE DOCUMENTS HAVE BEEN SUBMITTED.

Applications are only valid upon receipt of payment in full for the space. Vendors are not permitted to share space without the expressed approval of the Festival Director. Priority booth placement will be assigned on a First-Come, First-Served basis.

 

Liability Insurance

Vendors who carry general liability insurance need to submit a Certificate of Insurance as follows:

  • One Certificate of Insurance (Commercial General Liability: Min. limit of $1M per occ./$2M agg. and rated A-XII or better):

    • The City of San Jose, Silicon Valley PRIDE, its officers, agents, and contractors are named as additional insured.

    • 1346 The Alameda, Ste 7, PMB 508

    • San Jose, CA 95126

    • Naming the following: Silicon Valley Pride and their respective agents, employees, volunteers, board of directors, and the City of San Jose, as additional insured parties in the amount of one million dollars.

All vendors are required to have insurance.

 

Permits and Licenses

All participants shall supply their own permits and licenses, valid auto insurance, and liability insurance. A copy of these permits and licenses shall be submitted with the booth application. All sellers must possess a resale number, collect taxes, and be responsible for all of their own sales and collections. Applications are not complete without a copy of your seller’s permit.

 

Booth or Tent Structures

Booth or tent structures must be ordered through Silicon Valley Pride on the registration form.  Vendors may bring and set up their own tent structures. Tables and chairs will be available for rental as well. However, vendors are allowed to bring in these items. If you will provide your own structure, please contact us to discuss prior to submitting your application.

 

Electricity and Lighting

Electrical power is provided for all participating in the Night Festival.  Candles are not allowed. Limited additional electricity is available only if ordered on your booth application and approved by the festival director. Generators are not permitted!

 

Merchandise

Only items pre-approved by Silicon Valley Pride may be sold at the festival. This includes nonprofit organizations. All sellers must have a valid/current seller’s permit with the State of California’s Board of Equalization. Violators are subject to removal from the festival. Booth space may not be assigned, sold, traded, or shared without previous arrangements. Anyone selling items that do not match the description listed on your application will be asked to leave the festival without a refund. Only food vendors are permitted to sell or distribute food products or beverages, including water.

 

Photo Requirements of Goods

Artisan and business/commercial booths must submit several color photos of the booth with sellables on display. Food booths must submit a menu with pricing. Physical or electronic formats are accepted.  Festival management will be auditing goods sold to ensure compliance.

 

Menu Items

Only items pre-approved by Silicon Valley Pride may be sold. Please submit your menu and prices with your booth application. The presence of non-approved items may result in your dismissal from the festival.

 

Health Regulations

Health Permits are required for all food/concessions. Restaurant and other event permits are not valid for this festival. You may obtain a health permit from the Santa Clara County Health Department. You must follow all Health Department rules and regulations. Failure to comply will result in your dismissal from the festival.

If you wish, Silicon Valley Pride will obtain the necessary permit on your behalf and pass the cost to you without markup. Please contact SV Pride directly to arrange this service. 

 
Clean-up

Each participant is responsible for the condition of their space during and after the event. All participants may be held financially accountable for damages done to space and/or rented equipment, as well as, leaving a large amount of trash behind.

 

No Drugs, No Smoking, No Canabis, No Shrooms and Compliance with City, County, and State Laws and Regulations

By being a vendor at Silicon Valley PRIDE, you agree to comply with all regulations, laws, and requirements as set by the City of San Jose, the County of Santa Clara, and the State of California. This includes but is not limited to, no illegal drugs, no smoking, no cannabis or shrooms, and no other substances deemed illegal by the City, State, or County governments while being a vendor at Silicon Valley PRIDE.

Trademark

Unless otherwise authorized, Silicon Valley Pride reserves the exclusive rights to the use of its names, logos, themes, and symbols thereof.

Photographs and Grant of Rights

The Vendor and all Vendor Participants grant Silicon Valley Pride the right to take still or moving photographs, video, digital, audio, or other recordings (“Photographs”), and to reproduce, display, distribute, perform, digitize, transmit, broadcast, and otherwise use those Photographs, in any and all media and manners now known or hereafter discovered throughout the world in perpetuity in whole or in part, modified or altered, either by themselves, or in combination with other photographs or materials,  The Photographs may be used by Silicon Valley Pride for any purposes whatsoever including, without limitation, all promotional and advertising uses, on its web site, and for other purposes.  The Vendor expressly agrees to inform its Vendor Participants that they are granting these rights in consideration of the opportunity to participate in the Celebration.  The Vendor hereby forever releases and discharges Silicon Valley Pride from any and all claims, actions, and demands arising out of or in connection with the use of the Photographs, including, without limitation any and all claims for invasion of privacy, publicity rights, defamation, trademark rights, and all other rights.  The Vendor waives all rights to royalties, license fees, or other compensation related to the use of the Photographs. 

 

Disclaimer & Indemnification

Silicon Valley PRIDE, any of their contracted vendors, their employees, and board members shall not be held responsible for any depreciation or loss of any kind, including theft, physical violence, elements of nature, or other causes, however, they may originate. Silicon Valley PRIDE will supply night security but provides no guarantees or warranties concerning the goods left on the grounds or items left overnight. The participants may, at their own expense employ additional watch persons, with the approval of Silicon Valley PRIDE, and shall work under the direction of Silicon Valley PRIDE hired security.

 

Cancellations

All orders are final. There will be no refunds for cancellation. Silicon Valley PRIDE reserves the right to remove anyone from the festival grounds for any reason at any time.

COVID-19 ADDENDUM

By agreeing to participate as a vendor, you agree to follow all posted guidelines regarding health and safety rules, along with all CDC rules, regulations, and guidelines in place at the time of the Festival.

You agree to practice appropriate “social distancing” and to wear face coverings at all times in any and all posted locations, and you are encouraged to maintain these preventative practices even where not posted in order to reduce the risks of exposure to COVID-19.  BECAUSE COVID-19 IS EXTREMELY CONTAGIOUS AND IS SPREAD MAINLY FROM PERSON-TO-PERSON CONTACT, WE CANNOT GUARANTEE THAT OUR PARTICIPANTS, VOLUNTEERS, PARTNERS, OR OTHERS IN ATTENDANCE WILL NOT BECOME INFECTED WITH COVID-19.

In light of the ongoing concern of COVID-19, individuals who fall within any of the categories below should not attend the Parade, Festival, related events, and/or other face-to-face fundraising activities. By attending the Festival and all related events, you certify that you do not fall into any of the following categories:  

  1. Individuals who currently or within the past fourteen (14) days have experienced any symptoms associated with COVID-19, which include fever, cough, and shortness of breath among others;

  2. Individuals who have traveled at any point in the past fourteen (14) days either internationally or to a community in the U.S. that has experienced or is experiencing sustained community spread of COVID-19; or  

  3. Individuals who believe that they may have been exposed to a confirmed or suspected case of COVID-19 or have been diagnosed with COVID-19 and are not yet cleared as non-contagious by state or local public health authorities or the health care team responsible for their treatment.

  4. You agree to ensure that all members and volunteers of your Vendor booth engage in self-monitoring for signs and symptoms of COVID-19 (symptoms typically include fever, cough, and shortness of breath) and, seek medical advice and assistance if anyone experiences symptoms of COVID-19 within 14 days after participating in the Festival or related activities. You are encouraged to contact us at info@svpride.com, if any member of your vendor booth is diagnosed with COVID-19 within 14 days after your participation in the Festival or related activities.

 

ASSUMPTION OF THE RISK. I acknowledge and understand that my participation in the Festival and all related events includes possible exposure to and illness from infectious diseases including but not limited to COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS RELATED TO ILLNESS AND INFECTIOUS DISEASES, SUCH AS COVID-19, even if arising from the negligence or fault of GPCCSJ. I hereby knowingly assume the risk of injury, harm, and loss associated with the activity, including any injury, harm, and loss caused by the negligence, fault, or conduct of any kind on the part of GPCCSJ.

RELEASE. I acknowledge the health risks associated with my participation in the Festival and all related activities, including but not limited to transient dizziness, lightheaded, fainting, nausea, muscle cramping, musculoskeletal injury, joint pains, sprains and strains, heart attack, stroke, or sudden death.  I agree that if I experience any of these or any other symptoms during the Festival, I will discontinue my participation immediately and seek appropriate medical attention.  I DO HEREBY RELEASE AND FOREVER DISCHARGE THE GPCCSJ FROM ANY CLAIM WHATSOEVER THAT ARISES OR MAY HEREAFTER ARISE ON ACCOUNT OF ANY FIRST AID, TREATMENT, OR SERVICE RENDERED IN CONNECTION WITH MY PARTICIPATION IN THE ACTIVITY.
